AXEARC® is a registered brand name owned and managed by NYRA Softech Private Limited, trading as Sporty Bull, registered in Ireland under Company Number 712197. 

 

AXEARC® is a registered trademark and protected under EU trademark law. Any unauthorised use of the AXEARC name or logo is strictly prohibited and may result in legal action.

These Terms and Conditions 
(“Terms”) govern your access to and use of this website and any purchases made through it. By visiting the website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not accept these Terms in full, please do not use this site. Axearc is a premium sports brand operated under the registered business name Sporty Bull, a business registered in Ireland. Our website offers direct-to-customer retail services and provides information on our products and brand. References to “we”, “us”, or “our” throughout these Terms refer to Axearc and its operating entity.

SECTION 1 - Eligibility to Use

You must be at least 18 years old, or the legal age of majority in your country of residence, to place an order on this website. By using this site, you confirm that you meet this requirement and that you are fully able and competent to enter into a binding agreement with Axearc.

SECTION 2 - Formation of Contract

All orders placed through Axearc.co are subject to acceptance and availability. A contract is only formed when we dispatch the goods and confirm this to you in writing (typically via email). Submitting an order does not constitute acceptance on our part. We reserve the right to reject or cancel any order at any time and for any reason, including pricing errors, stock issues, suspected fraud, or violation of these Terms.

SECTION 3 - Product Information and Availability

We strive to present all product details, prices, specifications, and availability as accurately as possible. However, there may be occasional typographical or factual errors. Images on the website are for illustrative purposes only, and actual products may vary slightly due to production or screen settings. All products are offered subject to availability, and we reserve the right to discontinue or modify any product at any time without prior notice.


SECTION 4 - Price and Payment

All prices listed are in Euro (€) and include VAT at the applicable rate (currently 23%) unless otherwise stated. Shipping charges are additional and will be displayed clearly during the checkout process. We accept secure payments via Shopify Payments, Stripe, and PayPal. Payment must be received in full before goods are dispatched. We reserve the right to cancel any transaction if payment is not successfully processed or if we suspect fraudulent activity.

SECTION 5 - Shipping and Delivery 

We currently ship within Ireland and to selected international destinations. Estimated delivery times are provided at checkout and are intended as guidelines only. Delays may occur due to stock availability, courier issues, customs clearance, or other factors beyond our control. Axearc is not liable for any delays or associated losses once your order has been handed over to the delivery provider. Ownership and risk in the products pass to you upon delivery. If any item is missing or damaged in transit, please notify us within 48 hours of receipt.

SECTION 6 - Cancellation and Changes

You may request to cancel your order before it has been dispatched by contacting our support team. Once an order is processed and shipped, cancellation is no longer possible. In that case, you may initiate a return after delivery in accordance with our return policy. Axearc reserves the right to cancel an order at any time before dispatch, with a full refund provided in such cases.


SECTION 7 - Return and Refunds

We offer a 28-day return policy in line with consumer rights in Ireland. If you change your mind, you may return eligible items within 28 days of delivery, provided they are unused, in their original packaging, and in resellable condition. To initiate a return, please contact support@axearc.co with your order number and reason for 
return. Return shipping is at the customer’s expense unless the product is defective or
incorrectly supplied. Refunds will be processed within 14 days of receiving the returned item, using the same payment method used for the original transaction.
Important Exceptions:
- Personalised or customised items cannot be returned or refunded unless defective 
due to a manufacturer fault.
- Items damaged due to misuse, wear and tear, or unauthorised modifications will not 
be accepted for return or refund



SECTION 8 - Faulty or Incorrect Items

If you receive an item that is faulty, damaged, or not as described, please notify us within 14 days of receipt. You will be entitled to a replacement, repair, or refund, as appropriate and in accordance with your statutory rights. In such cases, we will cover the return shipping cost and work promptly to resolve the issue.

SECTION 9 - Use Of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the site. You must not engage in any conduct that is harmful, unlawful, abusive, defamatory, infringing, harassing, or disruptive to the site or its users. We reserve the right to suspend or permanently restrict access to the site if we believe you have violated these terms or used the site inappropriately.

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. SECTION 11 - Website Availability

While we strive to keep our website available 24/7, uninterrupted service is not guaranteed.
Access may occasionally be suspended due to:
- Scheduled maintenance or upgrades
- Unexpected technical issues or outages
- Disruptions caused by hosting or third-party service providers
- Cyberattacks or security threats
We are not liable for any loss arising from temporary unavailability or downtime of the
website.

To the fullest extent permitted by law, Axearc disclaims all warranties, express or implied,
related to the use of this website and our products. We shall not be liable for any indirect, incidental, punitive, or consequential damages arising from:

- Delays in delivery or product availability
- Errors or omissions in product descriptions
- Any loss of data, profit, or reputation
- Injury or damage resulting from product misuse
In all cases, Axearc’s maximum liability is limited to the purchase price of the affected
product.

suppliers, and partners against any claims, damages, liabilities, and legal expenses arising from your misuse of the website, violation of these Terms, or breach of applicable laws.

disputes arising out of or relating to the use of this site or purchases made through it shall be subject to the exclusive jurisdiction of the Irish courts.
